My 485 Visa Is Expiring in a Few Months and No Employer Will Sponsor Me, What Are My Options in Australia?
Search this and you will find a lot of lists. Employer sponsorship, skilled migration, partner visa, study again, go home. Every article names the same options, usually in the same order, as though you were standing in front of five doors and simply had to choose one.
You Are Not Choosing Between Five Doors. You Are Choosing Between the Options That Can Still Be Completed in the Time You Have Left.
An option that takes fourteen months is not an option when your visa expires in three. That is why the standard lists are useless, and why they leave people paralysed rather than acting.
So the useful question is not what is available. It is what can actually be finished before your expiry date, and what you have to do before that date arrives regardless of which path you pick.
The useful question is not what is available. It is what fits the time you have.
The Short Answer
The 485 cannot be extended. It is granted once in a lifetime, with one exception for regional graduates, and that exception must be applied for while you still hold a valid 485. Everything else depends on lodging a valid application for another substantive visa before your expiry date, because that is what triggers a Bridging Visa A and keeps you lawful. With three months left, most points-tested routes are already out of reach. Employer sponsorship, a second 485 if you studied regionally, and a partner visa if you are genuinely eligible are the realistic ones.
This article covers 485 expiry specifically. If you hold a 482 with sponsorship difficulties rather than a 485, our companion guide on what to do when your 482 is expiring with no new sponsor covers a different rule set and a different problem. If your 485 has already expired or you have decided your best option is study again, our guide on graduate visa expiring with no job offer covers adjacent scenarios.
485 Expiring in Weeks or Months? The Deadline Is Lodgement, Not Approval.
Whether the regional second 485 applies, whether an employer can still lodge in time, and whether a partner visa is genuinely available depend on details worth confirming before you commit to a path. Speak with a migration professional in the next few days.
There Is No Grace Period, and There Never Was One
If you have been reading about 482 visas you may have come across a 180 day period that applies when sponsored employment ends. That rule belongs to a different visa and a different situation. It does not apply to you.
The 485 is not tied to an employer, so there is nothing to cease and no cushion to fall back on. Your visa runs to its expiry date and then it stops. On the following day, if nothing else is in place, you are unlawful.
That sounds harsher than the 482 position and in one sense it is. But it also makes your planning simpler, because there is only one date that matters and you already know what it is.
The 485 Cannot Be Extended, and the One Exception Is Time Critical
The 485 is a once in a lifetime visa. There is no extension mechanism, and the two year skill shortage extension that some older articles still describe was discontinued in mid 2024.
There is one exception, and it matters enormously if it applies to you. Graduates who studied and lived in a regional area may be eligible for the Second Post-Higher Education Work stream, which can provide one to two further years. It is also considerably cheaper than the main streams.
If You Studied Regionally, Read This Part Twice
The second 485 must be applied for while you still hold a valid 485. Once your current visa expires, that door closes permanently.
This is the single most time critical item in this article, because it is the only option that both buys you real time and is cheaper than everything else on the list. If you studied in a regional area and your visa expires in a few months, check this before you check anything else.
Two things commonly catch people out here. Studying at a regional campus of a metropolitan institution is not automatically regional study, and the requirement generally concerns where you actually lived and studied rather than where the institution is headquartered. Check your postcodes rather than assuming.
The Only Thing You Must Do Before Your Expiry Date
Whatever route you end up taking, one mechanic sits underneath all of them.
If you lodge a valid application for another substantive visa while you still hold your 485, you are generally granted a Bridging Visa A. It comes into effect when your 485 expires and keeps you lawful, with work rights and Medicare access, while the new application is decided.
Your Deadline Is Not the Day You Need an Answer. It Is the Day You Need Something Lodged.
Lodge after expiry and you are already unlawful, your position is significantly worse, and if any later application is refused while you hold no substantive visa the section 48 bar can prevent most further onshore applications.
What Actually Fits in Your Remaining Time
This is the table nobody publishes, and it is the one that should decide what you do this week. The times below are broad planning estimates rather than guarantees, and they vary considerably by occupation, state and individual circumstances.
| Option | Realistic Time Needed | Viable at 3 Months? | The Catch |
|---|---|---|---|
| Second 485, regional stream | Weeks to prepare | Yes, if eligible | Must be lodged while your 485 is still valid. Cheapest option available. |
| 482 with an existing employer | 2 to 4 months to lodge | Often yes | Fastest if the employer already holds sponsorship approval. Nomination and visa can be lodged together. |
| 482 with a new employer | 3 to 6 months plus | Tight | If the business is not already an approved sponsor, add months. Filter for existing sponsors first. |
| 186 Direct Entry | Months | Rarely | Needs a skills assessment and an employer prepared to go straight to permanent. Uncommon for a recent graduate. |
| 189 Skilled Independent | Often 12 months plus | No | Skills assessment, then EOI, then an invitation you do not control. Not a three month plan. |
| 190 or 491 state nomination | Often 6 to 18 months | Rarely | Invitation timing is outside your control and state criteria change without notice. |
| Partner visa, onshore | Weeks to prepare | Yes, if genuinely eligible | Lodging while you hold a substantive visa avoids the Schedule 3 problem entirely. |
| Student visa | Not available onshore | No | Since 1 July 2024, 485 holders cannot apply for a student visa from within Australia. |
| Voluntary departure | Immediate | Always | Preserves a clean record and keeps offshore options open. Underrated. |
Read down the third column and the shape of your situation becomes clear. Most of what gets recommended in generic listicles is already unavailable to someone with a few months left. The routes that remain are employer sponsorship, the regional second 485, a partner visa if it is real, and departure.
If You Have an Employer But They Keep Saying Later
This is the most common version of the problem and it deserves its own answer.
Employers underestimate how long sponsorship takes because from their side it looks like paperwork. In reality the business may need to become an approved sponsor if it is not already, may need to run labour market testing, then prepare and lodge a nomination, then wait for a decision.
The practical consequence is that the conversation has to start much earlier than feels natural. Not when your visa is close to expiring, but the moment you meet the work experience threshold for the visa. By the time the deadline feels urgent to you, it is usually too late for the process to complete.
The Thing That Buys You Time
A nomination and a 482 visa application can be lodged at the same time. You do not need the nomination approved before lodging, and lodging is what secures your bridging visa. That makes an employer found in month two more workable than it appears.
If You Have No Employer At All
Then your position is harder and it is worth being direct about that rather than offering false comfort.
There May Be No Onshore Option That Completes in Time
With three months left and no sponsor, no lodged EOI with an invitation, and no eligible partner, there may be no onshore option that completes in time. That is not a failure on your part. It reflects processing realities that were set long before you got here.
Where that is the case, the two honest choices are to lodge whatever you are genuinely eligible for before expiry in order to hold status while you keep working on it, or to depart voluntarily before your visa ends.
Departing Before Expiry Is Materially Better Than Becoming Unlawful
It preserves a clean immigration record, avoids exclusion periods that can follow unlawful status, and keeps offshore applications straightforward. People treat it as giving up. It is closer to the opposite: it is the option that keeps the most doors open.
What to Do This Week
- Check your exact expiry date on VEVO rather than relying on memory.
- If you studied in a regional area, check your eligibility for the Second Post-Higher Education Work stream immediately. It is the only option that both buys time and costs less.
- If you have an employer, ask them today whether they already hold sponsorship approval and whether they will lodge before your expiry date. Get the answer in writing.
- If you are looking for a sponsor, filter for businesses that already sponsor. An employer starting from nothing adds months you do not have.
- Work out which options in the table above are genuinely open to you, and stop spending time on the ones that are not.
- Set your decision date at least six weeks before expiry, so that a lodgement is still possible if your first choice falls through.
- Do not let your visa expire while you decide. Lodging something you are genuinely eligible for is almost always better than lodging nothing. Get a free visa assessment if you are unsure what you are eligible for.
