Can I Apply for a Second 485 Visa if I Studied in Regional Australia, and Who Actually Qualifies?

Most explanations of the second 485 say it gives you one or two extra years depending on your regional category. That is true and it is not enough to work out whether you qualify, because there are two location tests and they are assessed separately.

The Short Version

You need a higher education qualification from an institution in a designated regional area, you must have held a Post-Higher Education Work, Post-Study Work or Replacement stream 485, and you must have lived in a designated regional area while holding it. Living in Sydney, Melbourne or Brisbane during that period rules you out completely. Duration is one or two extra years depending on the combination of categories, with a Tasmania exception. It must be lodged while your current 485 is still valid, and it is considerably cheaper than a first 485.

Category 2 covers cities and major regional centres, including Perth, Adelaide, Canberra, the Gold Coast, Newcastle, Wollongong and similar. Category 3 covers regional centres and other regional areas, meaning smaller and more remote locations. Category 1 is Sydney, Melbourne and Brisbane.

Where you have moved between categories during the relevant period, the shorter outcome generally applies. Short absences for a holiday or a work trip do not change your usual place of residence.

The Tasmania Exception

Both Residence and Study in Tasmania Gives Two Years Even From Category 2 Residence.

That is the one place where the ordinary matrix does not apply, and it is worth knowing if Tasmania is anywhere in your history. If both your residence and your study location were in Tasmania, you can be granted two years even where your residence was only in a Category 2 area.

Assuming a regional campus of a metropolitan institution counts. What matters is the location of the campus you actually studied at, so verify the postcode of that campus rather than the university head office.

Assuming a large city cannot be regional. Perth and Adelaide are Category 2. People discount themselves unnecessarily.

Check both postcodes against the Department current designated regional areas list. The study postcode comes from your campus, the residence postcode from where you actually lived while holding your first 485. Have evidence for both.

The Deadline That Catches People

This is the must-know timing point and it is the reason this article exists in the cluster.

No Grace Period

The Second 485 Must Be Applied for While You Still Hold Your Current 485.

Once it expires, the option is gone permanently. There is no grace period and no way to apply afterwards.

Lodging while your current visa is valid also secures a bridging visa, which keeps you lawful and working while the application is decided. Processing is not instant, so leaving it to the final weeks means gambling on a decision arriving before your visa ends, which is not necessary if you lodge earlier.

If you are eligible and your 485 has months rather than weeks left, this is the cheapest and simplest thing available to you. Do it before anything more complicated.

The honest position is that this is decided by choices already made. Where you studied and where you lived are in the past and cannot be adjusted now.

If you are ruled out, the second 485 is simply not part of your plan and the useful thing is to know that quickly rather than spend weeks on it. The routes that remain are employer sponsorship, state nomination, the 491, a partner visa where one is genuinely available, or a lawful departure before your current visa expires.
