Married on a Visitor Visa: Can You Apply Onshore? | Aussie Migration Guide
Married on a visitor visa in Australia - condition 8503 and the onshore 820 partner visa application

Married an Australian While on a Visitor Visa: Can You Still Apply for a Partner Visa Onshore?

In most cases, yes. You can marry an Australian citizen or permanent resident while you are here on a visitor visa and lodge an onshore partner visa, the subclass 820 and 801, without leaving the country. Whether you can does not turn on your marriage, your relationship, or how long you have been together. It turns on a four digit number that may or may not be printed on your visa grant letter.

September 2026 Announcement: Announced, Not in Force

On 17 September 2026 the Government announced attaching condition 8503 to visitor visas. As at today no commencement date has been published and no made legislative instrument has been located. The reported effect would apply to future grants, not existing holders. Nothing has changed for anyone yet. Section on this further down.

The Number That Decides It
Condition
8503

If It Is Not on Your Visa, You Are Very Likely Free to Lodge. If It Is on Your Visa, You Cannot Lodge Onshore Unless It Is Waived.

Here is the part that catches almost everybody: getting married is close to the worst argument you can make for a waiver, because the test specifically rules out changes you chose.

This page walks through both positions, the second trap that nobody writing about this mentions, and what the September announcement would change if it ever commences.

Married Here on a Visitor Visa and Not Sure If 8503 Is on Your Grant Letter? A Confidential Review Settles It Before You Spend on an Application.

Whether 8503 is attached, whether a waiver has any chance in your specific circumstances, and whether anything in your visitor application needs handling before you lodge a partner visa, all turn on your specifics. A partner visa specialist can confirm the position before an application is prepared.

Step One: Find Out Whether Condition 8503 Is on Your Visa

Do this before you plan anything else, including the wedding date if it has not happened yet.

  • Open your visa grant notification, the email or letter you received when the visa was granted. Conditions are listed by number.
  • If you cannot find it, check VEVO, the Department free visa entitlement verification service. It shows your current visa, its expiry and its conditions.
  • Look for 8503. The wording is usually "No further stay".

There are three positions you can be in, and they are not equally difficult.

What You FindWhere You Stand
No 8503You can generally lodge the 820 onshore while your visitor visa is still valid. Go to the next section.
8503 is listedYou cannot lodge a substantive visa onshore unless the condition is waived. Go to the waiver section. Do not lodge first and ask later.

Which Visitor Visas Usually Carry It

Migration lawyers describe condition 8503 as mandatory on the subclass 600 Sponsored Family stream and the Approved Destination Status stream, and discretionary on the Tourist and Business Visitor streams, meaning it is applied case by case and often based on the applicant country of passport. Commentary also indicates it cannot currently be imposed on the subclass 601 eVisitor or the subclass 651 electronic travel authority. None of that is a substitute for reading your own grant letter. Two people from the same country on the same stream can get different conditions.

If 8503 Is Not on Your Visa

This is the straightforward path, and it is the position most people are in.

You lodge the combined 820 and 801 application online while you still hold the visitor visa. On a valid lodgement you are normally granted a Bridging visa A, which comes into effect when your visitor visa expires and lets you stay lawfully while the application is decided.

Three things to get right.

  • Lodge before your visitor visa expires. If it expires first you become unlawful, and that puts you into Schedule 3 territory, which is a much harder application. Our guide on that is at Schedule 3 partner visa waiver.
  • Understand what the bridging visa does and does not give you. Work rights are not automatic in every case, and a Bridging visa A does not let you leave and return. Leaving Australia on a Bridging visa A ends it. If you need to travel you apply for a Bridging visa B before you go. We cover the detail at bridging visa work rights while waiting for the 820.
  • Expect to be here a long time. The 820 is a two stage visa and the wait is measured in years, not months. Figures are further down this page.

If 8503 Is on Your Visa, and Why Marriage Is the Wrong Argument

A waiver is possible. It is just that the test is built to exclude exactly the thing that has happened to you.

To waive the condition you generally need to show that compelling and compassionate circumstances have developed since the visa was granted, that those circumstances were beyond your control, and that they have caused a major change in your situation. If you have asked before, the new circumstances must be substantially different from the ones already considered.

Read the second element again. Beyond your control.

Migration lawyers are consistent on what this means in practice. Marrying an Australian, entering a de facto relationship and pregnancy are all described as generally insufficient on their own, on the reasoning that they were foreseeable and within the applicant control. The circumstances that do succeed tend to be things that happened to the applicant rather than things the applicant decided.

Generally AcceptedGenerally Not Accepted
Serious illness or accident affecting you or a close family member in Australia, with independent medical evidenceMarrying an Australian citizen or permanent resident
Death or serious illness of a close family member in Australia where your presence is neededEntering a de facto relationship
War, civil unrest or a natural disaster in your home country that materially affects your ability to leavePregnancy on its own
Circumstances that genuinely arose after the visa was grantedAnything that existed or was reasonably foreseeable when the visa was granted
A fresh request where the circumstances are substantially differentA repeat request restating circumstances already considered
The Decision With No Second Look

There Is No Appeal if the Waiver Is Refused.

A waiver refusal is not reviewable on its merits at the Administrative Review Tribunal. Judicial review may be available in limited circumstances where a legal error is argued, but that is not a second look at whether your situation was compelling enough.

This is one of the few decisions in the system with no merits review, which is the single strongest reason to get the request right the first time rather than sending something quickly.

Do Not Lodge the Partner Visa Anyway and Hope

This is the most expensive mistake available in this situation.

If 8503 applies and has not been waived, an onshore application for a substantive visa can be treated as invalid. An invalid application is not refused, it is not an application at all, which means there is no pending application and therefore no bridging visa flowing from it. People have ended up unlawful while believing they were protected by a lodgement that never existed in law.

It also does not go away when your visitor visa expires. The condition continues to affect you while you remain in Australia. Waiting it out is not a strategy.

The second trap most pages do not mention - what you said when you applied for the visitor visa can produce a partner visa refusal months later
The second trap is almost entirely missing from other pages on this topic. If the relationship status, intention to marry, or long term plans were not disclosed on the visitor application, the problem surfaces when the partner visa is assessed, not before.

The Second Trap: What You Said When You Applied for the Visitor Visa

This is the part that is almost entirely missing from other pages on this topic, and it causes refusals months later.

A visitor visa is granted on the basis that you intend a genuine temporary visit. If you applied for the visitor visa while already engaged, already in a long relationship with an Australian, or already planning to marry and stay, and you did not disclose that, two separate problems follow.

ProblemWhat It Does
Genuine visitor assessmentA decision maker looking at your partner application can see the visitor application. A pattern of arriving on a short visit and immediately lodging a permanent application invites the question of what you actually intended on arrival.
Public Interest Criterion 4020If information given in the visitor application was false or misleading, including an incorrect relationship status, PIC 4020 can be used to refuse the partner visa, and it carries an exclusion period. We cover how that works at PIC 4020 refusal for false or misleading information.

Two Things Worth Saying Plainly

First, relationships genuinely do begin or accelerate during a visit, and the Department knows that. Having married while here is not itself evidence of anything improper. Second, if there is a gap between what you declared and what was true, do not try to manage that yourself. Raise it with a migration lawyer before you lodge, because how it is addressed in the application matters far more than the fact itself.

What Was Announced on 17 September 2026, and What It Actually Means

On 17 September 2026 the Government announced a migration package which included attaching condition 8503 to visitor visas. At least one law firm reported the stated purpose as reducing onshore partner visa lodgements.

Here is the honest position as at 11 October 2026, which is nearly four weeks later.

QuestionAnswer Today
Has it commenced? No commencement date has been published and we could not locate a made legislative instrument.
Which visitor visas? Not confirmed. Commentary notes 8503 cannot currently be imposed on the 601 eVisitor or the 651 electronic travel authority, so whether the change reaches those subclasses depends on what the instrument does.
Does it affect visas already granted?Commentary indicates it would apply to future grants rather than existing holders. Reported, not confirmed.
What should you do about it?If you already hold a visitor visa without 8503, the announcement does not change your position. If you are about to apply for one, assume the condition may be attached and plan on that basis.

How to Read Any Page About This Change

Almost everything written about the September package was published in the week of the announcement and has not been revisited. If a page tells you the rule applies now, check whether it carries a date. An announcement is a statement of intention. A rule becomes law when an instrument is made, and until then nothing has changed for anyone.

What It Costs and How Long It Takes

The partner visa charge rose on 1 July 2026. Several sources put the current figure for the primary applicant at $11,710, up from $9,365.

ItemAmount or Time
Primary applicant chargeReported at $11,710 from 1 July 2026. Confirm on the Department fee page before you budget.
Additional applicant 18 or overReported at $5,860
Additional applicant under 18Reported at $2,935
Second stage chargeNone. One charge covers both the 820 and the 801.
Sponsorship application feeNone. Unlike employer sponsorship, there is no separate fee for the sponsor.
Refundable?Generally not, including on refusal or withdrawal.
820 processingAround 18 months at the 50th percentile and 32 months at the 90th. Indicative and it moves monthly.
801 permanent stageRoughly 6 to 15 months after you become eligible for it.

Two Timing Points That Are Worth Real Money

The permanent stage becomes assessable two years from the date the combined application was lodged, not from the date the 820 was granted. People routinely assume the clock starts at grant and add a year or more to their own expectations for no reason.

There is also a concession most cost calculators never mention. If, at the date the combined application is lodged, the relationship has lasted three years, or two years where there is a dependent child of the relationship, the two year wait does not apply and both stages can be granted together. Because it is measured at lodgement, a couple sitting just under the threshold can change their entire timeline by choosing when to lodge. That is worth getting advice on rather than guessing.

One more thing in your favour. Ministerial Direction 117 commenced on 25 July 2026 and gives onshore partner applications processing priority over offshore 309 and 100 applications, even where the offshore application was lodged earlier. If you are weighing onshore against offshore, that is a live factor. Current processing detail sits on our 820 partner visa processing time guide.

Where You Actually Stand

Your SituationWhat It Means
Visitor visa valid, no 8503Lodge before it expires. The main work is evidence of the relationship, not eligibility.
Visitor visa valid, 8503 attachedWaiver first. Marriage alone is unlikely to succeed as the reason. Get advice before writing anything to the Department.
Visitor visa already expiredYou are unlawful and Schedule 3 applies. This is still winnable but it is a different and much harder application. Act today, not next week.
Relationship status was not declared on the visitor applicationDo not lodge until you have spoken to a lawyer. PIC 4020 is the risk and it is manageable far better before lodgement than after.
Not yet in AustraliaYou have a real choice between the 309 offshore and travelling and lodging onshore. Direction 117 now makes that choice meaningful.

Frequently Asked Questions

Can I apply for a partner visa onshore after marrying while on a visitor visa? v
In most cases yes, provided your visitor visa does not carry condition 8503, the "No further stay" condition. Check your visa grant letter or VEVO. If 8503 is not listed, you can lodge the combined 820 and 801 application while your visitor visa is still valid, and a Bridging visa A normally keeps you lawful while it is decided. If 8503 is listed, you cannot lodge onshore unless the condition is waived first.
What is condition 8503 and how do I know if I have it? v
Condition 8503 is a "No further stay" condition that prevents the holder from lodging most further visa applications onshore. It is listed on your visa grant notification and can also be checked on VEVO. Migration commentary describes it as mandatory on the subclass 600 Sponsored Family and Approved Destination Status streams and discretionary on the Tourist and Business Visitor streams, though two people on the same stream from the same country can get different conditions. Always check your own grant letter.
Will getting married be enough to waive 8503? v
Generally no. The waiver test requires compelling and compassionate circumstances that developed since the visa was granted and were beyond your control. Marrying an Australian, entering a de facto relationship and pregnancy are described by migration lawyers as generally insufficient on their own, because they were foreseeable and within the applicant's control. The circumstances that succeed tend to be things that happened to the applicant, such as serious illness or a death in the family in Australia.
Can I appeal if the waiver is refused? v
No, not on the merits. A waiver refusal is not reviewable at the Administrative Review Tribunal. Judicial review may be available in limited circumstances where a legal error is argued, but that is not a second look at whether your situation was compelling enough. This is one of the few decisions in the system with no merits review, which is why the request has to be right the first time.
What if I just lodge the partner visa anyway? v
If 8503 applies and has not been waived, an onshore application for a substantive visa can be treated as invalid. An invalid application is not refused, it is not an application at all, so there is no pending application and no bridging visa flowing from it. People have ended up unlawful while believing a lodgement protected them that never existed in law. Do not lodge first and ask later.
Does the September 2026 announcement change my situation? v
As at 11 October 2026, no. The Government announced attaching 8503 to visitor visas on 17 September 2026, but no commencement date has been published and we could not locate a made legislative instrument. Commentary indicates the change would apply to future grants rather than existing holders. If you already hold a visitor visa without 8503, your position has not changed. If you are about to apply for one, plan on the basis that the condition may be attached.
What does the partner visa cost and how long does it take? v
The primary applicant charge is reported at $11,710 from 1 July 2026. One charge covers both stages, there is no separate sponsorship fee, and it is generally not refundable. Processing is around 18 months at the 50th percentile and 32 months at the 90th for the 820, with the 801 adding roughly 6 to 15 months after you become eligible for it. The clock to the permanent stage starts at the date of lodgement, not the date the 820 was granted, which is an important detail many people miss.
