Partner Visa Refused on Genuineness: What the ART Actually Looks For
Something Changed at the Tribunal in 2026 That Matters a Great Deal to You, Mostly Because of Who It Does Not Affect.
Student visa refusals must now generally be decided without an oral hearing. Partner visa reviews are not caught by that. A partner visa review still goes to a hearing in most cases, where you and your sponsor both give evidence and answer questions.
If your partner visa was refused on genuineness, the question that matters most is not whether you have a case. Most couples in this position do. The question is whether your material actually answers the four things the Tribunal is required to consider, and whether you can tell the difference between a documentation problem and a credibility problem. They need different responses, and getting it wrong is why reviews fail that should have succeeded.
A New Paper-Only Framework Exists. Partner Visas Are Not in It.
There is a new framework in the Migration Act for deciding certain temporary visa reviews on the papers, and it applies to visa types prescribed by the Migration Regulations. As at 18 May 2026, nothing has been prescribed under it.
Permanent visas are excluded from that framework entirely, and protection matters cannot be reviewed on the papers at all.
One Honest Caveat
The Tribunal retains a general discretion to decide a matter without a hearing where it appears reasonable, and that discretion is not limited to prescribed visa types. Before doing so it has to give the parties a reasonable opportunity to make submissions.
So a hearing is the strong expectation rather than an absolute entitlement, and it is a reason to put your material in properly rather than relying on the hearing to fix everything.
What "Genuine" Actually Means, Which Is Narrower Than You Think
Decision makers do not assess whether you love each other. They assess four specified aspects of the relationship, and a refusal is almost always a finding that one or more of them is not supported by evidence.
| Aspect | What is considered |
|---|---|
| Financial aspects | Joint ownership of real estate or other major assets, joint liabilities such as a mortgage, legal obligations one of you owes the other, sharing day to day household expenses, and pooling resources such as a joint account |
| Nature of the household | Whether you live together, joint ownership or a joint lease, shared responsibility for the care of children, joint utility accounts, shared responsibility for housework, and mail addressed to both of you at the same address |
| Social aspects | Whether the relationship has been declared to government bodies and institutions, joint travel and plans, statements from family and friends, whether you present as a couple socially, and joint membership or participation in activities |
| Nature of the commitment | The length of the relationship and how long you have lived together, knowledge of each other's personal circumstances which can be tested at interview, the companionship and emotional support you give each other, and whether you both see it as long term |
Read your refusal letter against that table. The reason the officer gave will map onto one or two of those four, and those are the ones your review has to answer. Everything else is secondary.
Why These Refusals Happen
Two causes account for most genuineness refusals, and they need different responses.
- Thin evidence across one or more of the four aspects. Couples with genuinely separate finances, or who live with family, or who are private about their relationship, are routinely under-evidenced on paper while being entirely real. This is a documentation problem.
- Inconsistencies, either between what you and your sponsor said, or between your statements and your documents. This is not a documentation problem and more documents will not fix it.
Do Not Ignore an Inconsistency and Hope.
The single most common mistake on review is to submit a thicker folder and say nothing about the discrepancy that caused the refusal.
The Tribunal has the original decision in front of it. An inconsistency that is explained can be accepted. An inconsistency that is left unaddressed reads as one you cannot explain, and it will be put to you at the hearing anyway, with less time to answer it.
Send Us the Refusal Reasons.
Send us the decision letter and we will tell you which of the four aspects it actually turns on, whether the concerns are answerable, and what evidence would answer them. If the honest answer is that the refusal was right on the law, we will tell you that rather than taking you through a two year review.
The Thing That Works in Your Favour
This is worth understanding properly because almost nobody realises it, and it changes how you should think about the wait.
The Tribunal Assesses the Relationship as at the Time of Its Own Decision, Not as at the Date of the Refusal.
Evidence from the period since you were refused counts.
The practical effect is that a wait which is otherwise miserable is doing work for you. Another year of a joint lease, another year of shared accounts, another year of family photographs and travel and declared relationship status, is evidence that did not exist when the officer refused you. A couple refused for a thin financial picture in year one often has a much stronger one by the time they are heard.
What a Review Needs That Your Original Application Did Not
- A response to the decision letter, point by point. Take each concern the officer raised and answer that concern with evidence. Not an assertion that the relationship is genuine, which is the conclusion rather than the argument.
- An explanation for every inconsistency, in writing, before the hearing.
- Evidence across the whole timeline, including since refusal, covering all four aspects rather than the one you find easiest to document.
- Statutory declarations from people who actually know you, containing specific observations. A declaration that recites the form wording and says the deponent believes the relationship is genuine carries very little. One that describes Christmas at a named person's house, who cooked, who was there and what was discussed, carries a great deal.
- Preparation for the hearing, for both of you. The questions will concentrate on the areas of concern in the refusal, which means you can anticipate most of them.
On the evidence itself, our page on what to gather and how to present it is at proving a genuine relationship.

The Hearing
Expect a long wait before it. Commentary puts the period from lodgement to hearing at many months and often more than a year, with the written decision following afterwards.
At the hearing you and your sponsor will both generally give evidence. Questions focus on the areas the refusal identified. Members do ask about personal circumstances, and some of those questions feel intrusive, because knowledge of each other's circumstances is one of the matters they are required to consider.
Two Things Worth Knowing in Advance
Small differences in recollection between two people are normal and are not fatal, which is a point worth holding on to if you are anxious about being caught out.
And the hearing is a merits review, so the Tribunal is deciding the question fresh rather than reviewing whether the officer made a mistake. For the process end to end, see the ART appeal process.
Review, or Lodge Again?
For a genuineness refusal specifically, review is usually the better route, and the reasons are particular to this ground.
| Review | Fresh application | |
|---|---|---|
| The evidence problem | Fixable. You can file material covering the period since refusal and answer the concerns directly | Also fixable, but you start the whole assessment again |
| The inconsistency problem | Can be explained to a decision maker who will hear you | Carried forward. The Department still holds the earlier file |
| Your status | The bridging visa generally continues while review is pending | Depends entirely on what you hold when you lodge |
| Cost | The Tribunal fee, with a reduction available on financial hardship and half refunded if you succeed | The full partner visa charge again, not refundable |
| Time | Long, but the time itself builds your case | Also long, and the time does not build anything |
The Exception
Where the relationship circumstances have genuinely changed rather than the paperwork, for example where you have since married, had a child, or crossed the long term relationship threshold. That is a different conversation and worth getting advice on before choosing.
What the Tribunal Can Do
1. Affirm the refusal
Which means it stands.
2. Set the decision aside and substitute its own
Finding that you meet the criteria.
3. Set the decision aside and send the matter back to the Department
With directions to continue processing, so that health, character and other checks can be completed. This is the most common successful outcome, and it is worth knowing in advance that winning usually means re-entering the queue rather than walking out with a visa.
What it cannot do is change the criteria. If the four aspects are genuinely not met, a sympathetic hearing does not alter that.
What to Do Now
- Check your deadline first. It is on your refusal letter, it cannot be extended in most migration cases, and it expires before your bridging visa does. We set out both clocks at partner visa refused onshore, the bridging visa deadline.
- Read the refusal reasons properly and map each one to the four aspects. That map is your brief.
- List every inconsistency the officer identified and work out the true explanation for each one.
- Keep living your life in a documentable way. Joint accounts, joint lease, declared relationship status, photographs with dates.
- Ask the people writing statutory declarations for specific observations rather than general support, and tell them why.
- Get advice before the hearing, not after it. The hearing is the one chance to answer the concerns in person.
If a request for information or a natural justice letter came before the refusal, how those work is at partner visa request for information.
