Working Holiday to Student Visa After 2 October 2026: The New Offshore Rule

Read First

The 417 and 462 Were Added to the Offshore List. The Second Working Holiday Visa Was Not.

Until 1 October 2026, a working holiday visa holder who decided to study could enrol in a course, lodge a student visa application without leaving the country, and carry on. That was one of the most common moves in the whole system.

From 2 October 2026 the 417 and the 462 were added to a list of seventeen visa subclasses whose holders cannot do that. The study is not the problem. The location of the application is.

Nothing about your current visa changed. Your work rights, your conditions and your expiry date are all the same. What changed is the shape of the next step.

If you came to this page because you were planning to switch from a working holiday visa to a student visa inside Australia, there is a more useful observation than just the offshore rule. The two routes have swapped relative difficulty, and almost nobody is telling 417 and 462 holders this yet.

The Two Routes Have Swapped, and Almost Nobody Has Noticed

A working holiday visa holder normally has two ways to stay on beyond the current visa. A second or third working holiday visa, which requires specified work and is widely treated as the annoying bureaucratic option. Or a student visa, which is widely treated as the easy escape hatch because you can buy your way into it with a course fee.

The Reversal

As of 2 October, the Annoying Option Is the One That Still Works in Australia.

Second Working Holiday Visa Can still be lodged onshore

Published requirement: you hold a substantive visa when you apply, or your last substantive visa expired less than 28 days ago, and you are in Australia when it is granted. Three months of specified work.

Student Visa Cannot be lodged onshore at all

Added to the offshore list on 2 October. Must be lodged from outside Australia, and you must be outside Australia when the visa is granted. No bridging visa while you wait.

The option that requires three months of farm work is now the one that does not require a flight. If you have already done your specified work, the order of preference has probably inverted since September. Check the working holiday route before you check the student route, not after.

The 28 Days You Still Have, and the 28 Days You Lost

There is a detail here that is almost poetic, and it costs people real money when they get it the wrong way round.

Same Number, Two Different Rules

The 28 Day Window Was Repealed for Student Visas. For a Second Working Holiday Visa It Is Still There.

Student Visa The 28 days are gone

The 28 day window that used to let a former student visa holder apply onshore without a substantive visa was repealed on 2 October 2026.

Second Working Holiday Visa The 28 days are still there

The published requirement still allows an onshore application where your last substantive visa expired less than 28 days ago.

So a person whose working holiday visa expired three weeks ago may still be able to lodge a second working holiday visa in Australia, and definitely cannot lodge a student visa in Australia. Those are two opposite answers to what feels like the same question. We are describing the published requirement for the working holiday visa here rather than quoting the provision, so if you are relying on that 28 days, confirm it before you lodge. It is the kind of thing worth paying an agent an hour for.

Studying Closes the Working Holiday Door Behind You

This is the consequence nobody mentions, and it is the strongest reason to decide in the right order.

The Pivot Is One Way

Specified Work Only Counts If It Is Done on a Working Holiday Visa.

Work done on other visa types, including a student visa, does not count toward the six months required for a third working holiday visa. Work done on a bridging visa that came into effect while a second working holiday visa was being processed can count, but a student visa is not that.

If you leave Australia, apply for a student visa offshore, come back and start studying, the time you then spend working is worth nothing toward a third working holiday visa. You have not paused the working holiday route. You have ended it. If there is any chance you want the third year, do the specified work and the second visa first, and treat study as the thing that comes after.

Not Sure Which of the Two Is Realistic for You?

If you are weighing a second working holiday visa against a student visa and are not sure which is realistic, send us your visa expiry date, how much specified work you have done and what you want to be doing in two years. That is enough to tell you which of the two is worth the money.

Why People Pivot to Study in the First Place

It is usually not about the study. It is usually about condition 8547, which limits a working holiday visa holder to a maximum of six months of work with any one employer unless an exemption or permission applies.

What Happens in Practice

Someone finds a job they like, the employer likes them, and then the six months runs out. The employer talks vaguely about sponsorship. The worker enrols in a course to buy time while that conversation goes nowhere.

That strategy now has a departure in it, and the departure is the moment to ask a harder question, which is whether the sponsorship conversation is real.

Our page on how to find a new sponsor as a work visa holder covers what a real sponsorship conversation looks like compared to a polite one.

Deciding between a second working holiday visa and a student visa after 2 October 2026 - the published requirement for the second visa still allows onshore lodgement, the student visa does not
Price the farm work route before you price the course fee route. The second working holiday visa still works onshore. The student visa requires a flight and a grant you receive while outside Australia.

About the Ballot

AnnouncedIn Force

45,000 Year Two Places and 5,000 Year Three Places Were Mentioned at the Announcement on 17 September 2026.

As at the date of this article the ballot is not law. No regulation has been made and no start date has been published, so applications today are assessed under the existing rules. We track the ballot separately on our page about the second and third working holiday visa ballot, and that page is the one to watch rather than this one.

It matters here only for sequencing. If you have your specified work and you are eligible now, the existing rules are the rules you have, and a route that is open today is worth more than a route that may become a lottery.

Your Next Steps Priced Against Each Other

If the farm work has been done, this is the shape of the conversation. If it has not been done, it is still the shape of the conversation. The order of preference depends on which boxes you already tick.

Your next stepCan you lodge it in Australia? What it costs you

Third working holiday visaYes, on the published requirementsSix months of specified work on the second visa, and you must have held two of them

If You Do Go the Student Route

Plenty of people reading this genuinely want to study, and for them the question is just logistics. Four things to build the plan around.

  1. The application must be lodged from outside Australia.
  2. You must be outside Australia when the visa is granted. Flying out to lodge and flying back to wait does not satisfy it. This is the single most common misreading of the new rule.
  3. An offshore application does not come with a bridging visa. Lodging it gives you no right to be in Australia.
  4. If you lodge in Australia anyway, the application is not valid, which means it is never considered. No decision, no bridging visa, and the charge is gone.

Work backwards from your visa expiry rather than forwards from today. Our main page on the 2 October changes sets out how to build that timeline, including the point at which it is too late to start.

Deciding, in Order

  1. Have you completed the specified work for a second or third working holiday visa? If yes, price that route first.
  2. If your working holiday visa has recently expired, check the onshore window for a second visa before you assume you have nothing.
  3. If you want the third year at any point, do not go to a student visa first. Work done on a student visa does not count.
  4. If the real driver is an employer and condition 8547, have the sponsorship conversation properly before you spend money on a course.
  5. If study is the actual goal, plan the departure and the grant location, not just the lodgement.

Common Questions

Can I still study in Australia on a working holiday visa? v
A working holiday visa allows a limited period of study, and that has not changed. What changed is that you cannot apply for a student visa from inside Australia. The study you can do on your current 417 or 462 is a separate question from the student visa.
I lodged my student visa application in September. Am I affected? v
No. Applications made before 2 October 2026 are assessed under the rules that applied when they were lodged. A valid onshore application is not made invalid by the change. If it was validly lodged, it continues on its original path.
Can I leave, lodge, and come back while it is processed? v
You would need another visa to return, and you would need to be outside Australia again when the student visa is granted. Returning carries the risk that the grant happens while you are here, which means you do not meet the criterion. It is not a plan to build a timeline around.
Does my farm work still count if I switch to a student visa? v
Not toward a third working holiday visa. Specified work has to be done on a working holiday visa. Work on a student visa does not count. If you have already finished the three months for a second visa, your work does count toward that application. If you are planning for the third year, going to study first ends the route rather than pausing it.
Is the ballot stopping me applying for a second visa right now? v
No. As at the date of this article no regulation has been made and no start date has been published, so the existing rules apply to applications lodged now. The 45,000 and 5,000 figures were announced on 17 September 2026 but have not been given legal effect. Our ballot page is the one to watch for the start date.
My working holiday visa expires in six weeks. What should I do first? v
Check whether you have the specified work for a second visa, because that is the only one of your realistic options that can still be lodged without leaving the country. Six weeks is not enough time to organise a course, a departure and an offshore grant. If the specified work is not done, start pricing a departure rather than a course.
Current as at 3 November 2026. This article describes the Australian rules that commenced on 2 October 2026. It is general information, not legal or migration advice. The onshore lodgement position for the second working holiday visa, the 28 day window and condition 8547 are described from a published requirement rather than from direct quotation of the regulation, so confirm the position for your passport country and your specific circumstances before you lodge anything.
